What Is the Do Not Call (DNC) Registry?

A DNC scrubber checks outbound call lists against Do Not Call registries and suppression files, flagging or removing numbers that cannot legally be contacted. For any organization making telemarketing calls, this process is a regulatory requirement. The FTC’s Telemarketing Sales Rule (TSR) mandates scrubbing against the National Do Not Call Registry at least every 31 days. The Telephone Consumer Protection Act (TCPA) imposes additional requirements around consent, autodialer use, and prerecorded messages.

With over 258 million active phone numbers on the National Do Not Call Registry, a significant portion of any consumer call list will include numbers that must be suppressed. DNC compliance software like DNCSolution® handles this process automatically, matching every number against the relevant federal, state, and internal data sources and delivering a callable list that satisfies regulatory requirements.

“Scrubbing only works when it is consistent and timely. Automate suppression as close to the point of send/dial as possible and validate results with regular sampling and reporting.”

What Does a DNC Scrubber Do?

A DNC scrubber compares every phone number on an outbound list against multiple compliance data sources, then flags or removes numbers that should not be contacted. The scrubbed output is a clean, callable list, and the scrub itself generates documented proof that the check took place.

Most enterprise-class scrubbers go beyond a simple registry match. They apply layered business rules covering consent status, exemptions, jurisdictional requirements, and contact-specific restrictions to determine whether each number is callable for a given campaign.

What Happens During a DNC Scrub?

Use a horizontal, six-step process graphic:

  1. Import the calling list
Batch upload, CRM connection, dialer integration, or API request.
  2. Check suppression sources
National DNC data, applicable state lists, and company-specific opt-outs.
  3. Evaluate permission and exemptions
Written permission, legally sufficient oral permission, EBR status, and campaign purpose.
  4. Apply number and jurisdiction rules
Wireless status, reassigned numbers, calling hours, holidays, and emergencies.
  5. Return a callability decision
Callable, suppressed, or manual review required.
  6. Create an audit record
Timestamp, sources checked, rules applied, and scrub receipt.

Automated DNC scrubbing helps reduce risk, respect customer choices, preserve permitted calls, and document each compliance decision.

Key Compliance Checks in DNC Scrubbing

          • National and state DNC registries: The TSR requires scrubbing against the National Do Not Call Registry at least every 31 days. A few states, such as Florida, Indiana, and Louisiana, maintain their own separate registries with additional requirements.
          • Company-specific suppression lists: Federal rules require businesses to maintain an internal DNC list of consumers who have directly requested not to be called. Numbers on this list must remain suppressed for at least five years, though some states require ten years, and many businesses choose to retain them indefinitely as a best practice.
          • Consent and exemption verification: Not every number on the National DNC Registry is off-limits. Valid exemptions include prior express written consent, prior express invitation or permission, and an established business relationship from a qualifying transaction or inquiry. A scrubber should apply these rules accurately so that lawfully callable contacts are not unnecessarily removed.
          • Reassigned-number data: The FCC’s Reassigned Numbers Database (RND) tracks numbers that have been permanently disconnected and potentially reassigned to a new subscriber. Calling a reassigned number can mean contacting someone who never gave consent, creating TCPA exposure.
          • Calling-hour, holiday, and emergency restrictions: Federal and state rules restrict when telemarketing calls can be placed. Some states observe specific holidays or declare states of emergency that temporarily prohibit outbound calling. A scrubber that applies these time-based restrictions prevents violations that are easy to overlook operationally.
          • Campaign, jurisdiction, and contact-purpose rules: Different campaigns may carry different consent requirements depending on the communication channel, the product being offered, and the jurisdiction. Advanced scrubbers apply configurable rules at the campaign level to reflect these variations.

The Business Benefits of DNC Scrubbing

DNC scrubbing supports compliance, but its value also extends to call center performance and customer relationships.

          Reduce Regulatory and Litigation Exposure

Automated scrubbing helps prevent calls that conflict with the TCPA, the TSR, state telemarketing laws, or internal opt-out obligations. DNC violations can trigger regulatory enforcement and expensive litigation. TSR violations carry civil penalties of up to more than $53,000 per non-compliant contact. TCPA statutory damages range from $500 to $1,500 per violation.

Implementing an automated DNC scrubbing tool also creates a consistent process across campaigns. This reduces dependence on agents making individual legal or policy decisions during outbound activity.

          Respect Consumer Choice

Calling consumers who have asked not to be contacted can quickly damage brand trust. A centralized scrubbing process helps apply a consumer’s request across the business, not only in the system where the request was first recorded.

          Improve Call Center Efficiency

Manual list reviews consume staff time and create opportunities for missed records and inconsistent decisions.

Automated scrubbing can provide agents with a clear callability status inside the tools they already use. Suppressed numbers are removed before they reach the dialer, while records with valid permission or an applicable exemption can remain available for appropriate outreach.

          Caller ID Reputation

Carriers and analytics platforms use complaint rates and calling patterns to flag outbound numbers as “Spam Likely.” Scrubbed lists reduce complaints and help keep numbers trusted.

          Create a Defensible Record

Scrub receipts, timestamps, applied rules, and historical records show how the organization evaluated a number before contact.

These records can help a business investigate complaints and demonstrate that documented compliance procedures were followed. They may also help preserve available safe harbor protections when an inadvertent violation occurs.

          Reduce Unnecessary Suppression

A basic scrub may block every number appearing on a DNC list. That approach can remove contacts who have provided valid permission or who fall within a lawful exemption.

Configurable rules distinguish restricted calls from permitted outreach, preserving engagement opportunities without weakening suppression controls.

          FAQs

How often must a business scrub its call lists against the National DNC Registry?

The TSR requires scrubbing at least once every 31 days. However, many enterprise programs scrub more frequently, often weekly or at the point of contact, to reduce risk and maintain safe harbor protections.

Does DNC scrubbing apply to text messages?

Text message marketing carries its own compliance obligations under the TCPA and TSR. Businesses sending automated marketing texts must obtain prior express written consent and honor opt-out requests as soon as possible and no later than 10 business days after receipt. A comprehensive DNC solution should cover Do Not Contact rules for SMS and text messaging alongside voice calls.

Can a business still contact a number that appears on the National DNC Registry?

In certain circumstances, yes. Valid exemptions include documented prior express written consent from the consumer, prior express invitation or permission, and an established business relationship (EBR) from a qualifying transaction or inquiry. EBR exemptions are subject to time limits. The business must be able to verify and document any exemption, and the consumer must not have made a company-specific DNC request.

What is a TCPA litigator list?

A litigator list identifies individuals known to file TCPA-related lawsuits against businesses. Checking outbound lists against a litigator list adds a layer of risk reduction beyond standard registry scrubbing. DNCSolution® includes access to a known TCPA litigator list as part of its TCPA compliance capabilities.

Can DNC scrubbing connect with a CRM or dialer?

Yes. APIs and other integrations can check contact status before an agent calls or before a campaign record reaches the dialer. Integration also helps distribute opt-outs across systems and reduces the delays associated with manual file exports.

Does a DNC scrubber delete telephone numbers?

Not necessarily. Most systems suppress restricted numbers from a campaign while preserving the underlying customer record. Deleting the full record could remove consent history, opt-out documentation, transaction data, and other information needed for customer service or compliance.
