AI and DNC Compliance

AI-generated calls, voice cloning and autodialed texts bring new Do Not Call risks. How regulators are responding and what companies must change to stay compliant.

AI and DNC Compliance

Artificial intelligence (AI) is rapidly transforming marketing, and compliance frameworks are working hard to keep up. AI-generated calls, voice cloning, and autodialed text messages have introduced new risks that regulators are beginning to address aggressively. As technology evolves, companies must rethink how they manage Do Not Call (DNC) compliance—or risk falling behind.

From updated interpretations of existing laws to new rulemaking on the horizon, the future of DNC compliance will demand more precision, transparency, and proactive management than ever before.

"AI can increase outreach velocity, which makes consistency and proof even more important. Document your rules, keep opt-out pathways clear, and maintain audit-ready records that demonstrate consents and opt-outs were honored end-to-end."
– Scott Frey, President & CEO, PossibleNOW

How Compliance Regulations Have Shifted With AI

In early 2024, the FCC issued a Declaratory Ruling confirming that AI-generated voices are classified as "artificial voices" under the TCPA. This means that any outbound call featuring an AI-generated voice requires prior express consent, just like prerecorded messages.

The FCC also proposed additional regulations that would:

  • Require clear and conspicuous disclosure that a call or text may include AI-generated content.
  • Mandate new identification standards for calls using AI technologies.
  • Explore how AI-detection and authentication tools could be integrated into compliance frameworks.

At the same time, the FTC and state regulators are targeting deceptive AI practices, particularly around impersonation and fraud, further tightening expectations for legitimate businesses.

Looking ahead, companies should expect expanded consent requirements, AI-specific disclosures, and deeper scrutiny of any outbound communication that leverages automation or artificial voice technologies.

Why AI-Powered Marketing Presents New Risks

AI marketing tools offer efficiency, but they also open the door to compliance vulnerabilities. Risks include:

  • Deceptive impressions: Voice cloning and synthetic voices could mislead recipients if not disclosed properly.
  • Increased mobile exposure: As mobile numbers dominate contact lists, mistakes around consent for autodialed texts or calls can trigger immediate liability.
  • Consent complications: If AI is involved in message generation, brands may face expectations for even more specific and layered consent.

The gap between what technology can do and what regulations require is narrowing quickly, and brands cannot afford to assume that past consent practices will meet future scrutiny.

How DNCSolution Supports Do Not Call Compliance Today

PossibleNOW’s Do Not Call solution is built to address today’s compliance realities—and offers the flexibility needed to adapt to tomorrow’s standards. Core capabilities include:

  • Real-time scrubbing against federal, state, and company-specific DNC lists.
  • Reassigned Numbers Database (RND) integration to prevent calls to recycled numbers.
  • Litigator List screening to minimize exposure to serial plaintiffs.
  • Wireless identification to manage risk when contacting mobile numbers.
  • DNCQuickcheck® tools for call center and agent network compliance.
  • CRM and SFTP integrations for seamless suppression management across systems.

Beyond these features, DNCSolution’s documentation and reporting capabilities allow companies to retain defensible proof of compliance—critical as regulators begin to look more closely at AI-impacted communications.

Future-Proofing Compliance with PossibleNOW

While AI’s role in marketing will only grow, regulatory frameworks will grow right alongside it. PossibleNOW’s DNCSolution is designed to scale with these shifts, offering businesses the automation, suppression accuracy, and consent tracking needed to stay compliant as standards evolve.

From voice cloning to automated texting, companies will face higher expectations around disclosure, consent, and auditability. PossibleNOW’s approach helps organizations not just react to regulatory change, but stay in front of it with tools that align outbound communication practices to current and future DNC compliance requirements.
