ATLANTA, GA – April 5, 2004 – PossibleNOW, the trusted source
for comprehensive Internet-based do not contact compliance solutions,
announces the availability of EBRSolution™, an online service to
assist direct marketers with the appropriate and effective use of
the Established Business Relationship
exemption in outbound calling campaigns. EBRSolution joins the DNCSolution™ suite
of online services that ensure complete, comprehensive do not contact compliance
with state and federal do not call, do not e-mail
and do not
mail laws.
Newly implemented Do Not Call laws have eliminated most exemptions. However,
one important exemption remains – the Established Business Relationship
(EBR) exemption. The federal government allows direct marketers to call
consumers for up to 18 months following their last transaction with the
company (order, ship date or payment), and up to 3 months from the last
inquiry. The state laws vary with respect to this exemption.
EBRSolution helps direct marketers solve the problem of safely calling
consumers and proving that they are in compliance with the EBR exemption.
With EBRSolution, direct marketers can demonstrate that proper procedures
are in place and that they are utilizing the exemption correctly.
“EBRSolution helps companies safely call existing and recent customers
and ensures compliance with Do Not Call laws,” explains Scott Frey,
CEO of PossibleNOW. “Utilizing the EBR exemption to place outbound
sales calls to consumers requires a high level of diligence since calling
a Do Not Call phone number without an EBR exemption is illegal.”
Frey continues, “The release of EBRSolution emphasizes our desire
to assist our customers with all aspects of their compliance activities.
EBRSolution is ideal for companies who want outbound telemarketing to continue
to be a viable means of selling in this new era of mounting regulatory
requirements.”
Companies can use EBRSolution to identify Do Not Call numbers and the
exact federal and/or state jurisdictions that apply. EBRSolution also includes
the following functions:
- Applies the correct and most stringent EBR rule
to each Do Not Call number identified. In some cases, state laws
are more restrictive than the federal.
- Creates a calling file with a “Good Through
Date” which is the date that a customer’s phone number
can be called based on the date of the last transaction or inquiry
- Archives the file and documents the process, and
provides an e-mail receipt to the direct marketer.
